Terms and Conditions

1. Introduction

Welcome to The Academy Clinic. These Terms and Conditions apply to: (a) Your use of the Website; and (b) Your access to assessment, support and, where appropriate, treatment in relation to complications referred via the Aesthetics Referral Centre (ARC). A contract for clinical services forms when we confirm Your appointment or when You attend an appointment, whichever occurs first. Our role and clinical responsibility are described in Section 6. If You do not agree to all of the terms, You must not use this Website or seek to access assessment, support of treatment from the ARC service..

2. Definitions

The following terms apply to these Terms and Conditions, Privacy Statement, Disclaimer Notice, and any related agreements:

  • Client, Customer, You, Your, and Patients refer to the individual accessing this website and accepting the company’s terms and conditions.

  • The Company, We, Us, and Ourselves refer to The Academy Clinic, located at 5th Floor Jasper House, 4-6 Copthall Avenue, London, EC2R 7DA.

  • Treating Practitioner: the clinician who conducts any assessment and/or treatment at the Complications Clinic

  • Party and Parties refer to both the Client and The Company, or either one individually.

Other definitions include:

  • Account: A unique account created for You to access our services.

  • Affiliate: An entity that controls, is controlled by, or is under common control with a party.

  • Aftercare Instructions: instructions provided to You by the Treating Practitioner following assessment or treatment.

  • ARC refers to the Aesthetics Referral Centre referral pathway through which a Referring Practitioner submits Your case for complications assessment.

  • Cookies: Small files placed on Your device by our website containing details of Your browsing history.

  • Complications Clinic: the clinic attended by You to access the Complications Clinic Services.

  • Complications Clinic Services: triage, assessment, advice, support, and any treatment provided by or via the clinic in relation to complications.

  • Personal Data: Information that identifies or relates to an identifiable individual.

  • Referring Practitioner: the practitioner who performed, or is responsible for, the original treatment and who refers Your case via ARC.

  • Service: Refers to our Website/Application and the services provided through it.

  • Service Provider: Any third-party company or individual employed by us to process data, provide services, or assist in the operation of our website or services.

  • Treating Practitioner: the clinician who conducts any assessment and/or treatment at the Complications Clinic

  • Usage Data: Automatically collected data such as visit duration or page views.

  • Website: Refers to The Academy Clinic website accessible from www.theacademyclinic.co.uk.

3. Personal Data and Confidentiality

We process Your health data to provide Services including but not limited to Aesthetic Treatments at the Academy Clinic and Complication Clinic Services at the Aesthetics Referral Centre, including sharing relevant information with Your Referring Practitioner and any Treating Practitioner involved in Your care, and storing clinical photography where necessary. We do so in accordance with UK GDPR and the Data Protection Act 2018. For full details, including lawful bases, retention and Your rights, see our Privacy Policy.

We comply with UK GDPR and the Data Protection Act 2018. Where You are referred via ARC, we will receive clinical details and medical photography submitted by Your Referring Practitioner, who is responsible for obtaining Your informed consent before submission. We store this information securely and it is only accessed by authorised clinical staff involved in Your care and, where relevant, at the time of Your appointment. We may disclose information where required by law or to appropriate regulators. We also share necessary information with Your Referring Practitioner and any Treating Practitioner for the purposes of Your care.

We will not sell, share, or rent Your personal information to third parties. Any communications from us will be related to the services we provide and will not include unsolicited marketing emails.

4. Availability of Services

We may triage and prioritise referrals based on clinical urgency and service capacity. We may decline to accept a referral or provide services where doing so would be unsafe, inappropriate, or outside our scope. While we take reasonable care in providing Complications Clinic Services, website materials are general and not a substitute for individual clinical assessment.

5. Medical Terms

5.1 The Complications Clinic provides specialist referral assessment and management of aesthetic complications. It is not an emergency service. If You believe Your condition is an emergency, call 999 or attend A&E. We may decline or defer services where outside scope, unsafe, or where further information is required.

5.2 All clinical assessment, diagnosis, and treatment decisions are made by the Treating Practitioner exercising their clinical judgement. Outcomes cannot be guaranteed and individual suitability will be assessed at the appointment.

5.3 Patient information. You shall provide a complete and accurate medical history and details of all prior treatments and follow all Aftercare Instructions given by the Complications Clinic and/or the Treating Practitioner. Our ability to manage Your complication depends on the information You share with us being accurate and complete. We may request information from You or Your Referring Practitioner (including product details and images). We may defer assessment/treatment until reasonably necessary information is received.

5.4 Before any assessment or treatment, You will receive information about the condition, options, risks, and likely outcomes, and You will be asked to sign a specific consent form. The consent form will also record: (i) where relevant, that certain medicines or devices may be used outside their licensed indications in accordance with clinical judgement; (ii) that further staged treatment may be required; (iii) that You may be referred to a different provider if clinically appropriate; and (iv) that You have received a copy of the consent information. You may ask questions and may decline or withdraw consent at any time.

5.5 Where Your initial assessment is funded by Your Referring Practitioner’s ARC subscription, there is no charge to You for that assessment. If Your Referring Practitioner does not meet applicable fees, we will inform You of the cost of the assessment. You may elect to proceed privately at our published rates notified to You in advance. We will not withhold emergency care on this basis.

5.6 Where You have been referred to the Complications Clinic by a Referring Practitioner who has an ARC subscription, the cost of the initial assessment is ordinarily met under that Referring Practitioner’s ARC subscription. If, for any reason, the Referring Practitioner does not pay the applicable subscription or case fee, You may be asked to pay for further consultations or treatment directly, at the Complication Clinic’s then-current published rates, before such further care is provided. The Clinic will inform the patient as soon as reasonably possible if this situation arises and will not withhold emergency care on this basis. If You elect to proceed privately, we will notify You in writing of the applicable fees (including any consultation, procedure, and consumables charges) and may require payment in advance. Current rates are available on our website.

5.7 We provide detailed explanations regarding the use and indications of products and treatments. You will have the opportunity, and are encouraged, to ask questions about procedures and are encouraged to seek further clarification before treatment. It is Your responsibility to ask any questions regarding the treatment before the procedure commences.

6. Intellectual Property

6.1 Medical Data: Any clinical reports, advice, or materials We provide are for Your personal use in connection with Your care and may not be copied or distributed for commercial purposes. Where You consent to clinical photography being taken by the Treating Practitioner or the Complications Clinic, You grant Us a licence to use the images for Your care and securely store them; any teaching or publication use shall be subject to separate explicit consent.

6.2 The content, design, data, and graphics on our website are protected by UK and international copyright laws. You may not adapt, alter, or create derivative works from any material contained on the website for commercial purposes. Unauthorized copying or incorporation into other websites or publications is prohibited. Framing of any part of the website is not permitted without express written consent.

6.3 All content on the website, including training materials, is protected by copyright and intellectual property laws. We reserve the right to take legal action for any unauthorized use of our intellectual property.

10. Disclaimers and Limitation of Liability

10.1 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be limited or excluded. We shall provide Complications Clinic Services with reasonable care and skill.

10.2 Subject to clause 11.1, Our total aggregate liability to You arising out of or in connection with a consultation or treatment shall not exceed: (a) the fee You paid for that consultation or treatment; or (b) where You did not pay a fee (because the service was funded under a Referring Practitioner’s ARC subscription), the fee that would have been payable as set out in the Complication Clinic’s then-current published rates for an equivalent privately billed consultation or treatment.

10.3 We are not responsible for loss or damage arising from Your failure to provide accurate and complete information or to follow Aftercare Instructions, or from complications caused by treatments performed elsewhere. We shall not be liable for loss that was not reasonably foreseeable, for indirect or consequential loss, or for business losses (as You are a consumer).

10.4 The Website and services on the Website are provided “as is” without warranties of any kind. We do not guarantee the accuracy, reliability, or availability of the website. We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of the website or services.

10.5 You agree to indemnify The Academy Clinic against any claims arising from Your use of the website or services. We recommend that You independently verify medical information before making decisions based on the content of the website.

10.6 To the fullest extent permitted by law, The Academy Clinic is not responsible for any loss, injury, or damage caused to persons or property resulting from the application of information found on this website.

11. Miscellaneous

11.1If we do not immediately take action against a violation of these terms, it does not waive our right to take action in the future. We are entitled to use our rights and remedies at any time, even if we previously chose not to enforce them.

11.2 If any provision is held invalid or unenforceable, the remainder shall continue in full force.

12. Complaints Policy

At The Academy Clinic, We are committed to giving Our clients the highest possible standards of care and service at all times. If Our performance does not meet Your expectations, We welcome feedback to enable Us to review how we might have done things differently and how We can use the feedback to improve the quality of Our services.

In the unlikely event that a client is unhappy with the service they have received, we have created the following complaints procedure to ensure we can resolve the issues as quickly and efficiently as possible. Clients are encouraged to contact us directly at info@theacademyclinic.co.uk to allow us the opportunity to address and resolve the complaint to their satisfaction.

If You are not happy with Our final response, or if We have been unable to resolve Your complaint within eight weeks, You may have the right to refer the matter to the Cosmetic Redress Scheme:

Please be aware that complaints must be referred to the Cosmetic Redress Scheme within a maximum of 12 months of Our final response to You.

13. Governing Law and Dispute Resolution

These Terms and Conditions are governed by English law. You and The Academy Clinic agree to submit to the exclusive jurisdiction of the courts of England and Wales, except where it is necessary to initiate enforcement proceedings outside England. This does not affect any mandatory rights You may have to bring proceedings in the courts of Your home jurisdiction.

14. Animals in the Clinic

Support animals are permitted in public areas and treatment rooms, subject to risk assessments. Patients must notify the clinic in advance if they plan to bring a support animal. We may require adjustments or refuse access to certain areas if necessary for infection control or safety, while making reasonable adjustments where required. The handler is responsible for:

  • Controlling the animal’s behaviour at all times.

  • Ensuring the animal is clean, healthy, and free of diseases.

  • Carrying the necessary documentation verifying the animal’s role (e.g., ID cards or medical notes).

15. Use of the Website

Users must be at least 13 years old and possess the legal authority to enter into these terms.

Users agree to provide accurate information and maintain the confidentiality of their Account credentials. Prohibited activities include misuse of the site, intellectual property infringement, and fraudulent behaviour.

16. Termination

We may suspend or terminate Your access to Complications Clinic Services where: (a) it is clinically unsafe or inappropriate to proceed; (b) You fail to provide required information; (c) there are safeguarding or regulatory concerns; (d) You engage in abusive, threatening or unsafe behaviour; (e) We cannot contact You despite reasonable attempts; or (f) required private fees are unpaid.

Where we terminate before providing a paid private service that You have pre-paid and You are not at fault, we shall refund relevant prepayments. Suspension or termination does not affect Your right to seek emergency care.

We reserve the right to suspend or terminate user Accounts or access to services for violations of these terms. Upon termination, You will lose access to Your Account and any enrolled services. We are not liable for any loss of data or access resulting from termination.

17. Changes to Terms

We reserve the right to update these terms at any time. Users will be notified of changes through the website or via email.

Changes take effect prospectively. For confirmed appointments, the terms in force at the time of booking will apply unless a change is required by law or for patient safety, or You agree otherwise.
